Information collected, processed, and reported in the course of those services is handled under separate client agreements, data processing terms, and applicable professional and legal standards, and is outside the scope of this policy.

Information you provide. When you submit an inquiry through a form on this site, we collect the information you choose to give us, such as your name, organization, email address, telephone number, and the contents of your message.

How to submit a request. You may submit a request by emailing support@smiaware.com or calling 888-299-9921. Please tell us which right you wish to exercise and the state in which you reside.

Verifying your request. Before acting on a request, we will take reasonable steps to confirm that you are the person the request concerns. We may ask you to provide information that matches what we hold about you, such as the email address or organization associated with the record we hold about you. We will use that information only to verify and process your request. If we cannot verify your identity, we may decline the request and will tell you why.

Authorized agents. Where permitted by law, you may designate an authorized agent to submit a request on your behalf. We may require the agent to provide written proof of authorization and may require you to verify your identity directly with us.

Our response. We will respond within the time required by applicable law, generally 45 days, and will let you know if we need additional time. We may decline a request where the law does not require us to honor it or where an exemption applies, and we will explain the basis for our decision. We will not discriminate against you for exercising your rights.

Appeals. If we decline all or part of your request, you may appeal by replying to our response or by emailing support@smiaware.com with “Privacy Appeal” in the subject line within 60 days. We will review the appeal and respond in writing within the time required by applicable law, explaining the reasons for our decision. If your appeal is denied, you may contact the attorney general of your state of residence.

Data retention

We retain inquiry information for as long as needed to respond to your request and for our legitimate business and recordkeeping purposes. Information collected through cookies and analytics is retained for up to 14 months, after which it is deleted or de-identified. Our analytics and advertising providers retain information under their own policies.

When we identify a website visitor as a prospective business contact and add their information to our customer relationship and outreach systems, we keep that information for as long as there is a legitimate business reason to do so. When a contact is no longer a current or reasonably foreseeable business prospect, we suppress the record from further outreach and, where appropriate, remove it.

Security

We maintain administrative, technical, and physical safeguards designed to protect the information collected through this site. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Children

This site is intended for legal and business professionals and is not directed to children. We do not knowingly collect personal information from children.
